City of Rochester - Monroe County
A little history
The Fire Police are about as old as firefighting itself. You can trace their roots
back to the bucket brigade days. They are in charge of traffic control, crowd
control, and scene safety to name a few. In 1939 the New York State General
Municipal Law created Article 10, Section 209-c, creating Fire Police.
According to the law, when working in their sworn capacity, they "shall have
the powers of and  render  service  as peace  officers". Article 2, Section
2.10(41) of the New York State Criminal Procedure Law also describes their
authority as follows. "Fire  police  squads  organized  pursuant  to section two
hundred nine-c of  the  general  municipal  law,  at  such  times  as  the  fire
department,  fire  company or an emergency rescue and first aid squad of the
fire department or fire company are on duty, or when, on  orders  of the  chief
of  the  fire  department  or fire company of which they are members,  they
are  separately  engaged  in  response  to  a  call  for assistance pursuant to the
provisions of section two hundred nine of the general   municipal   law
provided." Disobeying a Fire Police member violates New York State V&T
Article 23, Section 1102 which states "no person shall fail or refuse to comply
with any  lawful  order  or  direction  of  any police  officer or flagperson or
other person duly empowered to regulate traffic". Fire police members are
sworn in by local authority and registered with the New York state
Division of
Criminal Justices Services in Albany. The laws can be found at the New York
State Senate website. In 1953 the Volunteer Fireman Association Of The State
Of New York was created and today has over 2,500 members statewide. For
